| dc.description.abstract | O presente trabalho analisa o fenômeno da violência doméstica contra a mulher no Brasil, sob uma perspectiva interdisciplinar que abrange o Direito Penal, a Sociologia e a Criminologia Feminista. A pesquisa investiga a construção histórica do patriarcado e a transição da condição feminina de "objeto de tutela" para "sujeito de direitos", destacando marcos como o Estatuto da Mulher Casada, a Lei Maria da Penha e a Lei do Feminicídio. Foi empreendida uma pesquisa bibliográfica e documental, com análise de doutrina especializada, Artigos Científicos, Legislações Correlatas e Decisões Judiciais. O problema central da pesquisa foca no tratamento conferido pelo sistema judiciário brasileiro às mulheres que, inseridas em um ciclo de violência crônico e diante da ineficácia dos mecanismos estatais de proteção, cometem homicídio contra seus agressores. A fundamentação teórica utiliza o modelo do Ciclo da Violência de Lenore Walker e a Síndrome da Mulher Agredida para explicar a paralisia cognitiva e a "indefesa aprendida" que acometem as vítimas. No campo jurídico, discute-se a aplicação das excludentes de ilicitude, notadamente a legítima defesa, defendendo a necessidade de uma interpretação que considere a iminência da agressão de forma extensiva e humanizada, conforme o Protocolo de Julgamento com Perspectiva de Gênero do CNJ. A hipótese confirmada é a de que o ato extremo cometido por essas mulheres não se configura como vingança premeditada, mas como uma estratégia de sobrevivência frente ao fracasso das políticas públicas e ao risco iminente de morte. Conclui-se que a superação do androcentrismo jurídico e a adoção das premissas da Criminologia Feminista são fundamentais para que o Poder Judiciário ofereça uma resposta justa, sensível às assimetrias de gênero e capaz de reconhecer o contexto de vulnerabilidade que precede o fato criminoso. | |
| dc.description.resumo | This paper analyzes the phenomenon of domestic violence against women in Brazil from an interdisciplinary perspective encompassing Criminal Law, Sociology, and Feminist Criminology. The research investigates the historical construction of patriarchy and the transition of women from “objects of protection” to “subjects of rights,” highlighting milestones such as the Statute of the Married Woman, the Maria da Penha Law, and the Femicide Law. A bibliographic and documentary research was undertaken, with analysis of specialized doctrine, scientific articles, related legislation, and judicial decisions. The central problem of the research focuses on the treatment given by the Brazilian judicial system to women who, trapped in a chronic cycle of violence and facing the ineffectiveness of state protection mechanisms, commit homicide against their aggressors. The theoretical framework utilizes Lenore Walker’s Cycle of Violence model and the Battered Woman Syndrome to explain the cognitive paralysis and “learned helplessness” that afflict victims. In the legal field, the application of justifiable homicide defenses, particularly self-defense, is discussed, advocating for an interpretation that considers the imminence of aggression in an extensive and humanized way, according to the CNJ’s Gender Perspective Judgment Protocol. The confirmed hypothesis is that the extreme act committed by these women is not premeditated revenge, but a survival strategy in the face of the failure of public policies and the imminent risk of death. It concludes that overcoming legal androcentrism and adopting the premises of Feminist Criminology are fundamental for the Judiciary to offer a just response, sensitive to gender asymmetries and capable of recognizing the context of vulnerability that precedes the criminal act. | En |
