| dc.description.abstract | O presente trabalho analisa a constitucionalidade e a eficácia operacional do Regime Disciplinar Diferenciado (RDD) no sistema carcerário brasileiro como instrumento de neutralização das organizações criminosas. O objetivo central é investigar a tensão entre o pragmatismo da segurança pública e as garantias fundamentais, verificando se o isolamento de lideranças cumpre sua função estratégica sem violar tratados internacionais ou converter-se em um Direito Penal do Inimigo. A metodologia fundamenta-se em uma pesquisa qualitativa de cunho bibliográfico e documental, pautada na análise doutrinária, jurisprudencial, no exame minudente da Lei de Execução Penal (LEP) e em relatórios técnicos de monitoramento do Conselho Nacional de Justiça (CNJ). Os principais achados indicam que o RDD possui uma funcionalidade estratégica vital para a autodefesa do Estado, permitindo a interrupção da cadeia de comando das facções por meio da submissão imediata baseada em fundada suspeita, conforme autorizado pela legislação infraconstitucional. Todavia, a consolidação do crime organizado evidencia que o regime, embora eficaz na contenção tática imediata, atua em um cenário de falência ontológica do sistema penal comum, onde o vácuo de autoridade estatal é preenchido por estruturas de poder paralelo. Conclui-se que o RDD é constitucional e operante como medida de exceção, mas sua legitimidade depende do controle judicial sucessivo e da vigilância estrita contra abusos administrativos, evitando que o ímpeto repressivo aniquile os direitos remanescentes do apenado. A efetividade do isolamento mostra-se superior quando há monitoramento técnico rigoroso que reduz os índices de violência sistêmica, configurando o regime como a última ratio para a manutenção da soberania estatal intramuros. | |
| dc.description.resumo | This study analyzes the constitutionality and operational effectiveness of the Differentiated Disciplinary Regime (RDD) within the Brazilian prison system as a tool for neutralizing criminal organizations. The central objective is to investigate the tension between the pragmatism of public safety and fundamental rights, examining whether the isolation of criminal leaders fulfills its strategic function without violating international treaties or devolving into “enemy criminal law.” The methodology is based on qualitative research of a bibliographic and documentary nature, grounded in doctrinal and jurisprudential analysis, a detailed examination of the Criminal Enforcement Law (LEP), and technical monitoring reports from the National Council of Justice (CNJ). The main findings indicate that RDD serves a vital strategic function for the state’s self-defense, enabling the disruption of criminal factions’ chains of command through immediate detention based on reasonable suspicion, as authorized by infra-constitutional legislation. However, the consolidation of organized crime demonstrates that the regime, while effective in immediate tactical containment, operates within a scenario of ontological failure of the ordinary criminal justice system, where the vacuum of state authority is filled by parallel power structures. It can be concluded that RDD is constitutional and effective as an exceptional measure, but its legitimacy depends on ongoing judicial oversight and strict monitoring to prevent administrative abuses, ensuring that the repressive impulse does not annihilate the prisoner’s remaining rights. The effectiveness of solitary confinement is greater when there is rigorous technical monitoring that reduces rates of systemic violence, establishing the regime as a last resort for maintaining state sovereignty within prison walls. | En |
